What Simorg does and does not promise about Beta software, AI output, security, data, third-party components and the limits of our liability. Part of the Terms of Service.

1. Beta software

Simorg, its programming language, its execution engine, the Logos platform, Simorg Desktop, the machine service, the command-line client and every artifact, plugin and component we publish are in Beta. They are ready to build and experiment with, and they are still changing. Interfaces, formats, behaviour, limits and prices may change between releases; features may be added, altered or withdrawn; an update may require you to change what you have built; and no uptime, service level or continuity is promised.

We ask you to weigh this before relying on Simorg for production systems, for business-critical work, or for anything you cannot afford to lose or to do again. That decision, and responsibility for its consequences, are yours. This is the reason for everything that follows.

2. No warranty

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free or free of harmful components, or that they will meet your requirements.

3. Not for high-risk use

The Services are not designed, intended or certified for use in high-risk or safety-critical environments, including medical devices and systems, aviation, nuclear facilities, autonomous vehicles, weapons, critical infrastructure and financial trading, where a failure could cause death, injury, environmental damage or serious loss. Do not use them there.

4. AI output

The output of an AI system — an agent’s reply, a generated file, a suggested action — is produced automatically and can be inaccurate, incomplete, out of date, biased or inappropriate for your purpose, however confident it reads. It is not advice. Check it before you act on it, and treat every decision made with it as your own. We are not responsible for what any agent, ours or anybody else’s, says or does.

5. Security

We apply reasonable and appropriate security measures, described in the Privacy Policy, and we make no guarantee that the Services are free of vulnerabilities. You remain responsible for the security of your own applications, agents, dependencies, credentials, machines and deployment environments, and for the access you grant to any of them.

6. Data, backups and integrity

We do not guarantee the preservation, integrity or availability of data processed, stored or transmitted through the Services. Keep your own backups. Everything you hold on the Platform can be downloaded at any time from Settings → Your data, and everything an agent produces on your own computer is on your disk.

7. Third-party components, services and content

The Services work with software, services and content we do not control: container engines, payment providers, registries, language models, the artifacts other people publish and the systems your agents reach. Each is offered under its own terms. We do not endorse them and we are not responsible for their availability, security, legality, licensing or content. Our own Software contains open-source components under their own licences, whose notices travel with it.

8. Performance, compatibility and change

We do not guarantee any level of performance, backward compatibility or stability across versions. Features, interfaces, language constructs and artifacts may be changed, deprecated or removed, and continuing to use the Services may require you to migrate or rewrite what you have built.

9. Limitation of liability

To the fullest extent permitted by applicable law, Simorg is not liable for any indirect, incidental, special, consequential or punitive damage, or for any loss of profit, revenue, business, goodwill, data or use, or for the cost of substitute services, arising out of or in connection with the Services, however caused and under whatever theory of liability. Loss from relying on Beta software for production work, from an agent’s output, from a third-party component, service or artifact, or from data you did not back up is loss you bear yourself.

To the fullest extent permitted by applicable law, our total liability to a business customer for all claims in any twelve-month period is limited to the greater of the fees that customer paid us in the twelve months before the event giving rise to the claim and one hundred euros (€100).

Nothing here excludes or limits liability that the law does not allow to be excluded or limited: for death or personal injury caused by negligence, for fraud, for intent or gross negligence, a consumer’s statutory rights, or liability under laws implementing Directive (EU) 2024/2853 on liability for defective products. The cap in the second paragraph does not apply to consumers.

10. Indemnity

If you use the Services in the course of a trade, business or profession, you agree to hold Simorg harmless from claims, damages, liabilities and costs arising from your content, the agents you run or publish, the machines you offer, the access you grant, or your breach of the Terms or of the law. This does not apply to consumers.

11. No professional advice

Nothing the Services provide — documentation, tooling, an agent’s output or a message from us — is legal, financial, medical, engineering or other professional advice, and nothing certifies your use of the Services as compliant with any law or standard. Obtain professional advice where you need it.

12. Your compliance

You are responsible for ensuring that your use of the Services, and everything you build and publish with them, complies with the laws that apply to you, including data protection, consumer, export-control, intellectual-property and artificial-intelligence law, and with the licences of every component you use.
